Terms of Service

These Terms of Service ("Terms") govern your use of Expencil, the expense-tracking application available on the web at app.expencil.com and as the Expencil apps for Android and iOS (together the "Service"), operated by Sasan Ebrahimi - Oriexai Solutions, Germany ("Expencil", "we", "us" — see the Impressum for full provider details). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. The Service

Expencil lets you record one-off and recurring expenses, organize them in personal and shared spaces, split shared costs in groups, and view statistics about your spending. It is the same Service with the same account whether you use it in a browser or through the mobile apps. The core Service is available on a free plan with usage limits; a paid Pro subscription removes those limits (see Plans, subscriptions and billing). We may improve, change or discontinue features over time; if we ever discontinue the Service as a whole, we will give you reasonable advance notice so you can retrieve your data.

2. Your account

• You need an account to use the Service. You register with an email address and a password — confirming your address before signing in — or, where offered, by signing in with your Google account.
• You must provide accurate information and keep your credentials confidential.
• You are responsible for all activity that happens under your account. Tell us promptly if you believe your account has been compromised.
• You must be at least 16 years old to use the Service.

3. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• attempt to gain unauthorized access to the Service, other users' data, or the infrastructure the Service runs on;
• abuse the invitation features — email invites or invite links — to send unwanted messages or to invite people with misleading intent;
• interfere with the operation of the Service, for example by overloading it or introducing malicious code;
• circumvent or attempt to circumvent plan limits, rate limits or payment requirements, or drive metered features (such as AI voice capture) with automated bulk requests.

4. Your content

The expense data you enter belongs to you. You grant us only the rights needed to operate the Service: to store and process your data and to display it to you and to the members of the spaces and groups it belongs to. We claim no other rights over your content, and we do not sell it. See the Privacy Policy for how your data is handled.

5. Shared spaces

• When you add a record to a shared space, the members of that space can see it.
• Records you create can be edited and deleted only by you.
• The owner of a shared space controls its membership and may remove members or delete the space, which removes its data for everyone.
• Invite links are secrets: anyone holding a valid link can join. Revoke or regenerate a link if it has been shared too widely.
• You may leave a shared space at any time.

6. Groups, balances and money

• A group records what its members spent and how each expense was split, and computes the resulting balances and a suggested set of transfers.
• Expencil does not move money. It is a record-keeping tool: it holds no funds, processes no payments and is not a payment service or a money-transfer provider. Recording a payment in a group means telling Expencil that money changed hands elsewhere; settling debts between members is entirely between those members.
• Balances are calculated from the records members enter. Amounts in currencies without a published reference rate are counted one-to-one, which the app states where it matters. The figures are informational and are only as accurate as the data entered.
• Every expense and payment can be edited or deleted only by whoever recorded it. A group owner may close, reopen or delete the group; deleting it removes its data for everyone.

7. Plans, subscriptions and billing

• Plans and prices. The Service offers a Free plan with usage limits and a paid Pro subscription that removes them, billed monthly or yearly. Each plan's current limits and prices are shown in the web app (Settings → Plan) and on expencil.com; the price presented at checkout is the price you pay. We publish a fixed local price for many countries: where we list one for yours, that is the amount you pay in your local currency; elsewhere the euro price applies and may be converted at checkout. Displayed prices include VAT or similar taxes wherever pricing is tax-inclusive in your country; where prices are customarily quoted before sales tax (for example in the United States), the tax is added at checkout. In the mobile apps, prices come from the store's own catalog in your store country's currency.
• Where you buy. Pro can be purchased on the web, at app.expencil.com, and — where the apps offer it — inside the Android and iOS apps as an auto-renewing store subscription. A subscription from either channel applies to your account everywhere you use the Service, and while any subscription is active the Service will not sell you a second one.
• Payment processing. Web purchases are handled by Stripe on Stripe's own hosted checkout and billing pages. Purchases made inside the apps are billed by Google Play or the App Store through your store account and are additionally subject to the store's own terms. On no channel do we ever receive or store your card or payment details.
• Renewal. Subscriptions renew automatically at the end of each billing period until cancelled — web subscriptions through Stripe, store subscriptions through your Google Play / App Store account. If a renewal payment cannot be collected, the subscription ends at the end of the period already paid for and your account moves to the Free plan.
• The terms you bought are pinned. The plan version you subscribe to — its limits and its price — stays in force for the period you paid for. Changes we make to a plan apply to you no earlier than your next renewal, which happens at the then-current published version and price; we will announce price increases in advance.
• Upgrades and cancellation. Upgrades take effect immediately. Cancellation takes effect at the end of the current billing period, and you keep Pro until then. A web subscription is cancelled any time through Manage billing (Stripe's billing portal) in the app. A store subscription is managed and cancelled only in your App Store or Google Play subscription settings: the store runs the billing relationship, and we cannot cancel, pause or refund a store subscription for you. Deleting your account does not cancel a store subscription (see Section 10).
• Right of withdrawal and refunds. If you are a consumer in the EU or EEA, you may withdraw from a purchase within 14 days without giving a reason. For purchases made on the web: by subscribing you expressly request that we provide Pro immediately; if you then withdraw within those 14 days, we refund what you paid minus a proportional amount for the time of Pro already provided. To withdraw, email support@expencil.com from your account's email address within the period, stating clearly that you withdraw from the purchase. For purchases made through the App Store or Google Play, withdrawal and refunds are handled by the store under its own terms and processes — please direct refund requests to the store, as we have no access to the store's payments. Outside these rights, payments are non-refundable except where the law requires otherwise.
• If Pro ends. When a subscription ends — cancelled, expired or refunded — your account moves to the Free plan. Nothing you created is deleted, locked or hidden as a result: everything above a Free limit stays visible and editable, and members of your spaces and groups keep their access. Free limits only stop you creating new things beyond a cap.

8. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. Expencil is a personal record-keeping tool: statistics, budget progress, group balances and currency conversions are informational, based on the data you enter and public reference exchange rates, and do not constitute financial advice.

AI features. Features that use artificial intelligence — such as voice capture — generate suggestions automatically. Suggestions can be inaccurate, incomplete or wrongly attributed, and nothing is recorded until you have reviewed and confirmed it; you are responsible for checking AI-generated entries before saving them, and the saved records are yours like any other entry. Speech recognition runs on your own device, so its availability and quality depend on your device, browser and language; entering the same text by typing is always possible. AI features are provided as is, may be changed, rate-limited or withdrawn, and are no substitute for your own review of your records.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising out of your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Termination

You may stop using the Service at any time and delete your account yourself, effective immediately — in the app under Settings → Account, or on the web at app.expencil.com/delete-account (what deletion covers is described in the Privacy Policy; shared spaces and groups you own pass to their longest-standing member, and are deleted with your account if nobody else is in them). A subscription billed by us through Stripe ends with the account. A subscription billed by the App Store or Google Play does not end when the account is deleted — it runs on your store account, which only you can access: cancel it in the store's subscription settings, ideally before deleting the account, or the store will keep charging you for a service you no longer use. The deletion flow warns store subscribers about this. We may suspend or terminate accounts that violate these Terms or endanger the Service, notifying you when reasonably possible. If we terminate your account without cause while you have time left on a paid subscription, we will refund the unused portion of payments made to us (store-billed payments can be refunded only by the store, under its own process).

11. Changes to these Terms

We may update these Terms as the Service evolves. When we do, we will update the "Last updated" date on this page; significant changes will also be announced in the app. For paid subscriptions, changes to a plan's limits or prices reach you no earlier than your next renewal (see Section 7). Continuing to use the Service after a change takes effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Federal Republic of Germany. If you use the Service as a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you habitually reside.
